1. Acceptance of Terms

By accessing or using TradeRecovery AI (“the Service”), provided by VASA Trend AI LLC, a Florida limited liability company, doing business as “TradeRecovery.ai” (“we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

TradeRecovery AI is a software platform that provides AI-powered trading recovery tools, including trade data analysis, pattern diagnostics, personalized recovery plans, rule monitoring, coaching feedback, and educational content. The Service is accessible via web browser at traderecovery.ai and as a progressive web app.

3. Not Financial Advice

The Service does not provide financial, investment, or trading advice. All AI-generated diagnoses, recovery plans, coaching feedback, and analytics are for informational and educational purposes only. They do not constitute recommendations to buy, sell, or hold any financial instrument. You are solely responsible for your trading decisions and should consult a qualified financial advisor before making investment decisions.

Past performance data and statistics displayed within the Service are not indicative of future results. Trading involves substantial risk of loss and is not suitable for all investors.

4. Account Registration

To use the Service, you must create an account by providing a valid email address and password, or by authenticating through Google OAuth. You agree to provide accurate information and to keep your login credentials secure. You are responsible for all activity under your account.

You must be at least 18 years of age to use the Service.

5. Subscriptions and Payments

The Service offers free and paid subscription tiers. Paid subscriptions are billed monthly or annually through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

You may cancel your subscription at any time through the billing settings page or Stripe customer portal. Cancellations take effect at the end of the current billing period. We do not offer refunds for partial billing periods.

We reserve the right to change pricing with 30 days' notice. Existing subscribers will be notified by email before any price change takes effect.

6. User Data and Trade Information

You may upload trade data to the Service via CSV files, manual entry, or broker integrations (e.g., Interactive Brokers). You retain ownership of your trade data. We use your data solely to provide the Service features, including AI analysis, analytics, and coaching.

You represent that you have the right to upload any data you provide and that such data does not violate any third-party rights or agreements with your broker.

7. AI-Generated Content

The Service uses artificial intelligence (Anthropic Claude) to generate diagnoses, recovery plans, and coaching feedback. AI outputs may contain errors, inaccuracies, or unsuitable recommendations. You should independently verify any AI-generated content before acting on it.

We do not guarantee the accuracy, completeness, or suitability of any AI-generated content for your specific situation.

8. Broker Integrations

The Service may connect to third-party broker platforms (such as Interactive Brokers) to import trade data. These integrations are provided on an “as is” basis. We are not responsible for outages, data inaccuracies, or changes to third-party APIs. Broker integrations are read-only and do not execute trades on your behalf.

9. Prohibited Uses

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable regulations
• Attempt to gain unauthorized access to the Service or its systems
• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated tools to scrape, crawl, or extract data from the Service
• Share your account credentials with others or create multiple accounts
• Upload malicious files, viruses, or harmful content

10. Intellectual Property

The Service, including its design, code, AI models, educational content, and branding, is owned by TradeRecovery AI and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

11. Limitation of Liability

To the maximum extent permitted by law, TradeRecovery AI and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, trading losses, data loss, or other intangible losses, resulting from your use of or inability to use the Service.

Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

13. Account Termination

We may suspend or terminate your account at any time for violation of these terms. You may delete your account at any time through the settings page. Upon termination, your data will be deleted in accordance with our Privacy Policy.

14. Changes to Terms

We may update these Terms of Service from time to time. We will notify you of material changes by email or by posting a notice on the Service. Your continued use of the Service after changes take effect constitutes acceptance of the updated terms.

15. Governing Law

These terms are governed by the laws of the jurisdiction in which TradeRecovery AI operates, without regard to conflict of law provisions. Any disputes shall be resolved through binding arbitration or in the courts of that jurisdiction.
